Employee Versus Independent Contractor
Conducted by the Internal Revenue Service, Federal, State & Local Government Agents
It is critical that every entity paying compensation understands whether its workers are employees or are the individuals truly independent contractors.
On February 15, 2012, the IRS will be conducting two free teleconference trainings for West Virginia Government Entities. The calls will be held at 10 AM and 2 PM.
These calls are limited to the first 125 callers. The sessions are identical so please only attend one session.
On the date of the call, simply call toll free, 1-866-606-4717 and then enter access code 9612531.
We will discuss the basics of the Employee versus Independent Contractor Laws, provide scenarios that we have seen similar during audits where government entity misclassified employees, discuss reporting requirements, and discuss the tax consequences for improperly classifying an individual.
Special thanks to the West Virginia State Auditor’s Office for distributing this flyer to the local governments of West Virginia.

ATTENTION AND INVITATION TO ALL WEST VIRGINIA MUNICIPAL ATTORNEYS JOIN US IN FEBRUARY FOR AN INFORMATIVE AS WELL AS SOCIAL MEETING.
The first meeting of 2012, which will be held in conjunction with the West Virginia Municipal League’s Annual Meeting in Charleston (January 29th & 30th), will be an open meeting for all attorneys across the state who provide legal services to cities, towns and villages. This meeting will provide general information about the WV Municipal Attorney’s Association and its membership as well as to allow our current members to meet and network with other fellow municipal attorneys. We have sent notices out to fellow municipal attorneys and are asking that mayors and city managers involved with the WVML strongly encourage their legal representatives to attend.

The Village of Barboursville has old Christmas decorations that we do not use any more….they probably need some minor repairs.
We are trying to find someone who needs them, we are having space issues! They consist of eight (8) swags and several assorted hanging pole decorations. They must be picked up before January 1, 2012 and we will give them to the first person(s) to contact us.

Finance Joint
SB 616 – Relating to post-employment benefits generally (OPEB) Finance subcommittee C met to begin discussion of SB 616 from the 2011 Regular Session, which related to other post-employment benefits generally (OPEB). Near the end of the last session, members were close to a compromise bill dealing with OPEB but lawmakers simply ran out of time.
Funding sources were not agreed upon and need to be figured out. Funding sources need determined. Language regarding funding in draft legislation needs disregarded as is out of date and needs updated, all other facets had been agreed upon.
